      I. COMPLETED CAVITEX / MCTEP MILESTONES

      The government and its partners have already completed, inaugurated, and are currently operating infrastructure on my property (Lot PSU-219307). The “negotiation” phase ended as the following milestones were achieved over the decades:

      Long-Term R-1 Expressway Operation: My property has been integral to the R-1 (Coastal Road) connectivity for years without settlement.

      2023-2024: CAVITEX C5 Link Segment 2 (Sucat Interchange): This segment is fully operational, linking the R-1 Expressway to Sucat.

      March 30, 2026: Segment 3B Completion: President Ferdinand “Bongbong” Marcos Jr. officially opened the C5 Link Segment 3B. This project is now 100% operational, allowing thousands of vehicles to pass through the CAVITEX-C5 network daily.

      Retaining Wall & Flood Control: Permanent structures are now complete on my lot, blocking my Right-of-Way and proving a total physical “taking” of the 767 square meters verified in the August 15, 2025 Memorandum.

      II. MANDATORY OBLIGATION TO PAY

      Presidential Fund Allocation: Following the August 2024 confirmation of the 60 Billion ROW fund, and under the leadership of Secretary Vince Dizon, there is a clear mandate to resolve legacy claims that block infrastructure progress.

      DENR-LMB Finality (Dec 27, 2024): The Land Management Bureau has explicitly ruled that the DPWH holds the sole and mandatory obligation to pay. Pointing to the PRA or TRB is a documented delay tactic.

      Administrative Authority: A Disbursement Voucher (DV) is already active in my name. Per DPWH D.O. No. 19, s. 2017, the Regional level has full authority to sign and release the check immediately.

      III. ADMINISTRATIVE DEMAND

      Under RA 11032 (Ease of Doing Business) and the “Zero Backlog” mandate, your office is in violation for failing to settle a 40-year-old claim for a project that is already generating toll revenue.
